RealContact Pay As You Go Service Plan Terms
- Term & Termination. The initial term of this Agreement shall be as set forth in the Order Form. The initial term shall commence on the launch date unless otherwise stated in the Order Form. At the end of the initial term, this Agreement shall automatically renew for subsequent (1) one- month terms unless terminated by either party in writing. Either party may terminate this agreement in any renewal term by providing a minimum of thirty (30) days notice. BoomTown reserves the right to modify the Fees and/or the Terms of this Agreement during any renewal term provided that BoomTown notifies Client at least sixty (60) in advance. Any such increase shall apply after the then current subscription term ends.
- CHARGES & EXPENSES
- Service Plan & Fees. RealContact offers various subscription plans with different follow up methods and lead limits (the “Service Plans”). Client may elect to use RealContact Applications & Services, by selecting one of the Service Plans during sign up. By selecting a Service Plan, Client agrees to the applicable pricing, follow up methods and lead volume of the Service Plan. The subscription may be terminated in any renewal term. If terminated, it will terminate at the end of the then-current month. There will not be any credits or refunds for amounts accrued or paid prior to such termination.
- Service Plan Changes. If the text only Service Plan is selected, as set forth in the Order Form, Client may add on calling. If calling is added or dropped mid month, the bill will be adjusted to the newly selected rate for the days following the plan’s change. Days prior to the plan change will be charged at the original rate.
- Service Plan Overages. If the monthly lead limit is surpassed, each additional lead will be charged at the price per lead rate associated with the selected plan.
- Mobile and Data Charges. Client is responsible for any mobile and data charges that they may incur for using the Applications & Services, including text-messaging.
- PAYMENT OF FEES. Client agrees that BoomTown will bill Client’s credit card for the Fees, renewals and any related taxes. Service Plan fees are included in BoomTown package invoicing and are billed in advance at the start of each month. Overage fees are billed in arrears in the month following when the charges were incurred. If Client fails to pay the amount due within (72) hours of the due date, RealContact may suspend the Service until paid in full or terminate this Agreement. If Client terminates their subscription, overage fees incurred in the final term will be billed in the month following the final term. There will not be any credits or refunds for amounts accrued or paid prior to termination.
RealContact Tiered Commitment Service Plan Terms
- Term & Termination. The initial term of this Agreement shall commence upon sign up. Service plans have an initial term of (1) one-month. At the end of the initial term, the plan is automatically renewed for subsequent (1) one- month terms unless terminated by client in the BoomTown system. Client must terminate subscription by 11:59 PM EST on the last business day of the then current term to qualify for end of current month’s cancellations. BoomTown reserves the right to increase any RealContact Service Plan fees at any time upon reasonable notice. Any such increase shall apply after the then current subscription term ends.

- Service Plan Changes. Client may upgrade or downgrade Service Plan lead tiers mid month. Client will be charged the rate of the last selected Service Plan lead tier when the Service Plan fees are billed in arrears the following month. Client may add or drop calling at any point. Client will be charged the rate of the last selected Service Plan when the Service Plan fees are billed in arrears the following month. Upon renewal, Client will be charged the rate of the last selected Service Plan.
- Service Plan Overages. Client may upgrade their plan to a higher lead tier as they are approaching the selected plan’s lead limit. If the lead tier is not increased and the monthly lead limit is surpassed, each additional lead will be charged at the price per lead rate associated with the selected tier.
Mobile and Data Charges. Client is responsible for any mobile and data charges that they may incur for using the Applications & Services, including text-messaging.
